Governor’s Rule and Emergency Imposed in Khyber Pakhtunkhwa

ISLAMABAD: The federal government has moved to impose emergency measures in Khyber Pakhtunkhwa (KP) amid rising security concerns and political tensions with the provincial government.

The federal cabinet approved the imposition of an emergency on Sunday. A summary was subsequently sent to President Asif Ali Zardari for final approval, according to the Prime Minister’s Office.

The proposed measures involve Articles 232 and 234 of the Constitution, which deal with emergency provisions and the failure of constitutional machinery in a province.

Security Concerns Cited as Grounds

The federal government has cited an increase in terrorist incidents and serious security threats in KP as grounds for considering extraordinary constitutional measures.

According to the proposed justification, attacks on government installations and law enforcement agencies have increased, creating serious risks to public safety and law and order.

The government has also raised concerns about the provincial administration’s response to terrorism. Federal officials have alleged that the KP government has not taken adequate steps to address the security situation.

The governor’s report has also been cited in discussions about the province’s constitutional and administrative functioning.

Constitutional Provisions Under Consideration

Article 232 provides for the proclamation of an emergency under specified circumstances, including serious threats to Pakistan’s security caused by war, external aggression or internal disturbance beyond a provincial government’s capacity to control.

Article 234 deals with situations in which the provincial government cannot be carried on in accordance with the Constitution. It provides a separate procedure for the president to take constitutional action following a report from the provincial governor.

The two provisions have different procedures and legal consequences. Their implementation would depend on the formal decisions and constitutional requirements applicable to each measure.

Earlier Discussions on Emergency Measures

The latest move follows several days of consultations among federal leaders over the security and political situation in KP.

President Zardari and Prime Minister Shehbaz Sharif discussed the situation during a meeting at the President’s House. Federal officials subsequently considered possible constitutional steps.

The proposed measures come amid tensions between the federal government and the PTI-led provincial administration over counterterrorism policy and political developments in the province.

The formal status of the proposed measures depends on the president’s decision and the relevant constitutional procedures.
